OpenAI has told European users that advertising is coming to ChatGPT's Free and Go tiers before the end of August, closing the last major gap in a commercial rollout that began in the United Kingdom earlier this summer. The notice went out by email on August 13 and arrived alongside a revised privacy policy that spells out how ads get selected, measured, and controlled — the disclosure work that European law requires before a single sponsored result can appear.

The regulatory framing matters more than the launch date. OpenAI's EU advertising policy, updated on June 2, commits the company to explicit opt-in consent as the legal basis for personalizing ads, rather than the looser legitimate interest justification that many platforms leaned on until enforcement tightened. Users who do not actively agree should see nothing personalized, and consent must remain withdrawable at any moment.

A different bargain than the ad web

That distinction separates ChatGPT's model from the default arrangement most Europeans encounter online, where personalization is switched on and burying the opt-out is treated as a design challenge. OpenAI has also repeated that conversation content stays private and is not handed to advertisers, a claim that will draw scrutiny precisely because chat transcripts are the most intimate behavioral dataset any consumer product has ever accumulated.

What remains unclear is how much signal an opted-in user actually surrenders. There is a wide gap between selling access to raw conversations, which OpenAI denies doing, and using inferred interests derived from those conversations to choose an ad, which the policy language does not obviously rule out. European regulators have spent the past decade litigating exactly that gap with other platforms, and the answer will likely be settled by a data protection authority rather than a blog post.

Consent as an engineering problem

Building an opt-in flow that satisfies GDPR is harder than it sounds inside a conversational interface. Consent must be specific, informed, and as easy to revoke as to give, which means the setting cannot be buried three menus deep or bundled with unrelated preferences, and a refusal cannot degrade the underlying assistant. That constraint explains the timing: the continental launch lagged the earlier British one by roughly two months while the consent architecture and the policy text describing it were finished.

The updated privacy policy also has to explain measurement, not just selection. Advertisers pay for evidence that an impression did something, and every counting mechanism — attribution windows, conversion pixels, aggregated reporting — is itself a processing activity that needs a lawful basis and a plain-language description. Publishing that detail in advance is a compliance requirement in the EU, and it gives researchers and regulators a document to hold OpenAI against later.

What it means for productivity users

For anyone using ChatGPT as a work tool on a paid plan, nothing changes today. For teams standardizing on the free tier — a common pattern in small companies and schools — the calculation shifts, because an assistant that recommends a product now has a commercial reason to recommend one product over another, even if the sponsored slot is clearly labeled and separated from the answer.

Labeling discipline is therefore the thing worth watching, not the ad load. If sponsored placements stay visually distinct from generated responses, ChatGPT ads look like search advertising with better targeting. If the boundary blurs under revenue pressure, the trust that made the assistant useful for research and drafting erodes quickly, and European regulators will have both consent rules and unfair commercial practice rules available to say so.
